But as the Biden Administration has doubled down on requiring COVID-19 vaccination—including proposing a rule that businesses with more than 100 employees mandate vaccination—for some Republicans, opposition to mandates is proving to be an essential credential for showcasing leaders’ conservative bonafides. On Oct. 11, Texas Gov. Greg Abbott—who has opposed masking but came under fire from a Republican political rival recently for allegedly failing to push back hard enough on federal vaccine mandates—took a strong stand against vaccine mandates, issuing an executive order banning any “entity” in Texas from mandating vaccination for people who object to the vaccine for any reason, including “personal conscience.” [time-brightcove not-tgx=”true”] Stuck between following federal guidance and the state executive order, representatives for high-profile businesses based in Texas told TIME that they feel that federal law as well as employees and customers’ safety supersedes Abbott’s rule. And those that already required employees to be vaccinated have no intention of changing course. Dell, which is based in Round Rock, Tex., and boasted revenue of $92.2 billion last year, is requiring employees to be vaccinated or submit to weekly testing to work in the office. “Any employee or contractor who experiences challenges with the policy will have the option, by role, to work remotely,” the company told TIME in a statement on Oct. 12. “We believe this policy provides multiple options for anyone who works for or with Dell, and allows us to maintain safe working environments around the world.” IBM, which has large offices in Austin, Houston, Dallas, and San Antonio and reported revenue of $73.6 billion last year, said all direct employees of federal contractors must be vaccinated by Dec. 8, or get a medical or religious exemption. “We will continue to protect the health and safety of IBM employees and clients, and we will continue to follow federal requirements,” the company told TIME in a statement. The air travel industry, which has come out strongly in favor of vaccine mandates, has also declined to change course. American Airlines, the largest airline in the U.S. which has its headquarters in Fort Worth, told Bloomberg that it feels the pending federal rule “supersedes any conflicting state laws.” The company is requiring all employees be fully vaccinated by Nov. 24. A spokesperson for Southwest Airlines, which is headquartered in Dallas, echoed American Airlines in a statement to TIME, writing, “federal action supersedes any state mandate or law, and we would be expected to comply with the President’s Order to remain compliant as a federal contractor.” Southwest employees must be vaccinated by Dec. 8. Other organizations responded to Abbott’s rule with greater caution. Chevron, which has facilities in Texas and is one of the largest oil companies in the world, told TIME that its employees who travel internationally, work offshore in the Gulf of Mexico, or work aboard tankers must be vaccinated. (Petr Svab/The Epoch Times) Aside from being put on unpaid leave, New York City teachers who’ve declined to get the COVID-19 vaccine won’t be allowed to keep their health benefits for another year unless they give up their right to sue the city over its vaccine mandate. This condition was the result of an arbitration invoked by the city’s largest teachers union, the United Federation of Teachers (UFT). The union touted the arbitration verdict as a victory that forced the city to acknowledge medical and religious exemptions to the vaccination. It also allowed the teachers to take a year of unpaid leave with continued health care coverage or voluntarily resign with unused sick days paid out and a year of continued health insurance. But the UFT Sept. 10 press release on the issue left out the caveat that the health benefits would only continue beyond Nov. 30 for those who sign waivers preventing them from suing the city for getting fired. It did include a link to the arbitration verdict that, on page 17, states the waiver requirement. But several teachers told The Epoch Times the DOE only explicitly told them about the condition about a week ago, right before the mandate went into effect. Based on last week’s data, several thousand teachers and other school workers remain unvaccinated. An official with the city’s Department of Education (DOE) distanced the agency from imposing the waiver requirement. “This stipulation was given out by a third-party arbitrator,” the official told The Epoch Times on the condition of anonymity. “Unions and DOE both agreed to it; DOE didn’t make this decision.” But the arbitration verdict says its rulings “reflect” what the parties agreed to before and during the mediation as well as the “language” the parties agreed to in response to the arbitrator’s interim rulings. It suggests that the conditions of the unpaid leave in particular were left to the parties to sort out. “I concluded the parties are more familiar with Department [of Education] policy and how leave and entitlements have been administered in accordance with prior agreements,” the arbiter said. The ruling says the affected employees have from Nov. 1 to 30 to extend their leave and the connected benefits. “An employee must file a form created by the DOE which includes a waiver of the employee’s rights to challenge the employee’s voluntary resignation, including, but not limited to, through a contractual or statutory disciplinary process,” it says. It’s not clear how hard the union pushed against the requirement. It hasn’t responded to a request for comment. The issue underscores the dissatisfaction of the unvaccinated teachers with both the city and the union. They feel justified in holding back on the vaccine and believe the city has tossed them aside and the union failed to protect them, according to several conversations between them and The Epoch Times. The vaccines, developed in record time and still in the process of clinical trials, are known to cause severe side effects such as myocarditis, particularly in young men, and blood clots, though authorities and experts say these are rare and pose a lower risk than the disease itself. The vaccines don’t necessarily prevent one from contracting and spreading COVID-19, but clinical trials indicate they minimize symptoms, which are primarily a concern for the elderly or those with preexisting conditions. In fact, while you did nothing to ‘find yourself’ in this position, you have a very active role – to chart this territory for your organization, clear a path in the ever-changing terrain, and guide your employees along with as few casualties as possible. How then can you navigate this task? I’ve been studying medical decision-making, publishing academic papers about it, and consulting within the industry for nearly two decades now. Health and medical choices raise ethical issues for everyone. My guiding principle—based on my education and the knowledge that I bring in psychology and behavioural economics—is to make sure that information is conveyed clearly so that people can understand it. As an employer, I suggest you solve the foggy ethical issues by using safety as your guiding principle. This, followed by principles that consider the complexity of the matter, will empower you to maximize health and minimize grudges. The ABCDEF model I developed suggests that you: Acknowledge beliefs and concerns. Be transparent about your policy. Cite the law. Do not get into medical arguments. Enforce. Form alternatives, where possible. But safety first. The only way an employer can tread there safely is by making employee safety their North Star. Actual safety, in the physical sense, is, therefore, the first item on my list. Ironically, the Safety First movement was formed in the early 20th century to protect employees from hazardous working conditions. Now the hazard to employees comes from their own choices, which they are free to make, as long as safety isn’t compromised. This goes for vaccinations, as well as for masking and other protective measures. Though people are free to make decisions, their choices affect others, and the consequences can be harmful. The only person that is safer when you get vaccinated is yourself. Yes, you supposedly decrease viral load with vaccines which then decreases the number of people you infect if you get it, but the best way to really decrease infecting others is to not be in super spreader situations with them. Or to take the proper precautions if you must be in those situations. With that in mind, you should make your workplace into a non-super-spreader event (open windows, good air filtration, meetings outdoors, etc.). That’s actually practicing safety first. However, such precautions are not always possible. Good luck having an outdoor meeting, or keeping the windows open, when it’s 12 degrees. Good luck being an unvaccinated nurse who needs to measure blood pressure while maintaining social distance from the patient. This is why, as an employer, vaccinations are your best, most consistent line of protection. Some employers, like the City of New York, are now enforcing vaccination mandates, such as for school workers. But not every employer can or wants to take such steps. How then can you keep everyone safe and everyone’s emotions (more or less) intact? Acknowledge Beliefs And Concerns Employees’ emotions cannot be wrong, even if their fears are unfounded. It’s a fine line, and you’d better not cross it. People need to be heard, so hear them out, merely reflecting back their words, a technique taken from Imago Relationship Therapy. Acknowledging helps maintain the employer-employee relationship that can definitely be trying when at this point, as employers navigate legal demands, safety concerns, keeping the business going, and employee preferences. This is what acknowledging sounds like: “I hear you. You believe that you eat organic food and work out, and you think this will protect you from COVID, so you do not need to vaccinate.” Mind you, acknowledging does not mean agreeing. Be Transparent About Your Policy Trust is the foundation of all relationships, including our relationships with institutions and governments and lack of transparency. When there isn’t reasoning behind decisions, trust is eroded. Create a policy that is founded on the law, and make it known to all, with no exceptions. If the COVID terrain changes and the policy needs to change, then, by all means, change it, but again, make it crystal clear what the changes are based on. Cite The Law You are not arm wrestling with your employees when you ask that they vaccinate or that if they choose not to vaccinate, they maintain social distancing,  mask up at all times, and provide negative proof of testing once a week. You’re merely following the law. Companies have a legal right to require employees to get vaccinated unless they have a conflicting disability or religious belief. That is one strong argument. In fact, if you neglect to follow the law, you might expect backlash from employees. There have been lawsuits against employers for being COVID-negligent, especially when employees got sick. Do Not Go Into Medical Arguments Chances are you are ill-equipped to deal with arguments like, “I have endometriosis, and the vaccine will hurt my fertility even further,” or, “My entire family was sick; my father died from COVID, and I was near him the whole time. So, for sure, I have antibodies or some natural immunity and do not need the vaccine.” These are conversations that you do not want to have or even need to have. Because there is no winning here. As I suggested above, you can acknowledge concerns by reflecting them back, even if you find no medical evidence that they are valid. And in any event, it is not your role to determine the validity of medical claims or to change employees’ views with data. Enforce Rules are worthless unless followed. Remember, COVID vaccination and other rules are meant to protect employees and to allow them to work together. Once you cut corners, such as allowing your most essential employee to show up unvaccinated and unmasked, you compromise safety and throw transparency out the window. That said, enforcement needs to be done both firmly and politely. The employer can say, “Our policy, based on the law, is for unvaccinated employees to bring negative COVID testing. You failed to do so, and I ask you to leave the premises right now.” Insults are unacceptable in any context (such as “are you so stupid that you don’t want to vaccinate against a disease that killed over 700,000 Americans?!). But so is neglecting to follow up on the company COVID policy you’ve outlined. Form Alternatives For example, is it possible for employees to work from home? This would remove the friction between the vaccinated and unvaccinated. If so, offer this possibility to both vaccinated and unvaccinated employees, so you’re not discriminating against anyone. Act within reason, all the while remembering that this is a workplace, so it’s problematic if people cannot do their jobs. For example, if a nurse won’t adhere to the vaccine mandate for healthcare workers, she cannot phone in an ER shift. Indeed, the State of New York has mandated vaccinations for healthcare workers because safe alternatives could not be found. But it did so with legal backup and allowed time for employees to meet the requirement. Conclusion These steps should allow you to keep everyone’s emotions intact: both yours and your employees’ - vaccinated and unvaccinated. And, above all, to keep everyone healthy. Keep everyone productive because when teams are also comprised of friends, they perform better. And most importantly – follow this model to keep everyone safe. Judge Overrules NY Governor - Says Employers Must Grant Religious Exemptions To Healthcare Workers A federal judge in New York ruled on Tuesday that State Health Officials must allow employers to grant religious exemptions to a Covid-19 vaccine mandate for healthcare workers while a lawsuit challenging the mandate proceeds through the courts, according to the NY Times. "The question is whether the State’s summary imposition of § 2.61 conflicts with plaintiffs’ and other individuals’ federally protected right to seek a religious accommodation from their individual employers," wrote Judge David N. Hurd, a Bill Clinton appointee. "The answer to this question is clearly yes. Plaintiffs have established that § 2.61 conflicts with longstanding federal protections for religious beliefs and that they and others will suffer irreparable harm in the absence of injunctive relief," reads the 27-page ruling, which offers a reprieve for thousands of unvaccinated doctors, nurses and other healthcare workers who would have otherwise been fired or prevented from working on Tuesday if the ruling had gone the other way. Hurd issued a preliminary injunction preventing the NY Department of Health from acting against any employer who grants religious exemptions, adding that the plaintiffs were likely to succeed in their case. "The Department of Health is barred from interfering in any way with the granting of religious exemptions from Covid-19 vaccination going forward, or with the operation of exemptions already granted," reads the ruling. New York Governor Kathy M. Hochul indicated that the state would appeal. "My responsibility as governor is to protect the people of this state, and requiring health care workers to get vaccinated accomplishes that," she said. "I stand behind this mandate, and I will fight this decision in court to keep New Yorkers safe." In late-August, Hochul's administration overrode a religious exemption contained within former Gov. Cuomo's original vaccine mandate - prompting 17 healthcare workers to sue the state in federal court, claiming that the mandate conflicted with their religious beliefs "because they all employ fetal cell lines derived from procured abortion in testing." "With this decision, the court rightly recognized that yesterday’s ‘front line heroes’ in dealing with Covid cannot suddenly be treated as disease-carrying villains and kicked to the curb by the command of a state health bureaucracy," said Christopher Ferrara of the Thomas More Society. Tuesday's order technically extends an earlier temporary restraining order which applied to religious exemptions filed in mid-September onward - effectively allowing many healthcare workers to continue working even after the mandate went into effect. In the federal case, titled Dr. A et al v. Hochul, the 17 health care workers argued that they could not consent to be inoculated with vaccines “that were tested, developed or produced with fetal cell lines derived from procured abortions.” Pope Francis has said that Catholics may get the Covid-19 vaccines; most of the health care workers suing in the case are Catholic. "This new information shows that holding firm on the vaccine mandate for health care workers is simply the right thing to do to protect our vulnerable family members and loved ones from COVID-19," Hochul said in a statement. "I am pleased to see that health care workers are getting vaccinated to keep New Yorkers safe, and I am continuing to monitor developments and ready to take action to alleviate potential staffing shortage situations in our health care systems."Although healthcare workers have higher vaccination rates than the general population in the US, those who refuse vaccinations against coronavirus will place an added strain on already understaffed hospitals and care facilities. The attempt to equate being unvaccinated with stupidity and ignorance suffered a massive blow on Wednesday night when NBA star Jonathan Isaac was asked why he was hesitant to take the vaccine. Like many unions, the NBA's player union has refused a vaccine mandate, and Isaac, the 23-year-old player with the Orlando Magic who previously had and recovered from COVID, gave a stunningly compelling, informed, well-reasoned and thoughtful exposition on his rationale for not wanting the vaccine. Isaac also defended the right of individuals to make their own choice. One need not agree with his ultimate conclusion on the vaccine to see how groundless (and obnoxious) it is to claim that anyone who chooses not to take the vaccine — like him — is stupid, ignorant and primitive. I really encourage everyone to watch his two-minute master class in demonstrating why such a choice can, depending on one's circumstances, be perfectly rational: Is there anyone who can argue with a straight face that Isaac sounds stupid, ignorant or evil? One can cogently dispute the wisdom of his conclusion: while it is true that most people who recover from COVID (as he did) enjoy "natural immunity” in the form of antibodies — indeed, one major study found that “the natural immune protection that develops after a SARS-CoV-2 infection offers considerably more of a shield against the Delta variant of the pandemic coronavirus than two doses of the Pfizer-BioNTech vaccine" — some studies conclude that immunity is stronger still with the vaccine. Nonetheless, Issac is indisputably right that the risk of dying or becoming seriously ill from COVID is extremely low for someone like him: early 20s, healthy and with natural immunity. In fact, during the entire course of the pandemic, the total number of people aged 15-24 (Isaac's age group) who have died of COVID — in a country of 330 million people — is 1,372: fewer than the number in that age group who have died of non-COVID pneumonia. Add onto that Isaac's physical fitness and the fact that he already had COVID once, and it is clear that his risk from contracting the virus is vanishingly small. On Saturday, Speaker Nancy Pelosi’s House quietly tucked an enforcement mechanism into their $3.5 trillion “reconciliation” bill, passed it out of the Budget Committee, and sent it to the House floor. Buried on page 168 of the House Democrats’ 2,465-page mega bill is a tenfold increase in fines for employers that “willfully,” “repeatedly,” or even seriously violate a section of labor law that deals with hazards, death, or serious physical harm to their employees. The increased fines on employers could run as high as $70,000 for serious infractions, and $700,000 for willful or repeated violations—almost three-quarters of a million dollars for each fine. If enacted into law, vax enforcement could bankrupt non-compliant companies even more quickly than the $14,000 OSHA fine anticipated under Biden’s announced mandate. The Biden Administration has already started implementing its vaccine mandate enforcement blueprint: The Occupational Safety and Health Administration (OSHA) set precedent this summer and published an emergency Covid-19 rule in the Federal Register taking jurisdiction over and providing justification for Covid-19 being a workplace hazard for healthcare employment. Early in September, Biden announced his 100-or-more employee Covid-19 vaccine mandate and tasked OSHA with drafting an enforcement rule to exert emergency vaccine compliance authority over companies with 100 or more employees. The legislative provision that passed the Budget Committee raises the OSHA fines for non-compliance 10 times higher – and up to $700,000 for each “willful” or “repeated” violation. Speaker Nancy Pelosi has not announced when the House will vote on the reconciliation bill that includes the new OSHA fines. If the legislation is enacted, OSHA could levy draconian fines to enforce Biden’s vaccine mandate, a move that could rapidly bankrupt non-compliant companies. The Biden mandate affects employers collectively employing an estimated 80 million workers. The Democrats are playing hardball.                       President Biden embraced an aggressive stance earlier this month when he challenged Republicans who are threatening lawsuits over what they decry as his federal overreach: “Have at it. … We’re playing for real here. This isn’t a game.” The Legislation The provision tucked in the House reconciliation budget bill (on page 168) that increases OSHA fines reads: SEC. 21004. ADJUSTMENT OF CIVIL PENALTIES. (a) OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970.—Section 17 of the Occupational Safety and Health Act of 1970 (29 U.S.C. 666) is amended— (1) in subsection (a)—   (A) by striking ‘‘$70,000’’ and inserting ‘‘$700,000’’; and (B) by striking ‘‘$5,000’’ and inserting ‘‘$50,000’’; (2) in subsection (b), by striking ‘‘$7,000’’ and inserting ‘‘$70,000’’; and (3) in subsection (d), by striking ‘‘$7,000’’ and inserting ‘‘$70,000’’ That provision would change existing law relating to OSHA’s enforcement fines, the very same section of law whose fines OSHA referenced in its June Covid-19 healthcare worker rule and is likely to use again to enforce its forthcoming vaccine compliance rules. The Existing Law 29 U.S.C.§ 666 lays out OSHA enforcement fine levels. The 1970-enacted law reads: 29 U.S. Code § 666 - Civil and criminal penalties (a) Willful or repeated violation Any employer who willfully or repeatedly violates the requirements of section 654 of this title, any standard, rule, or order promulgated pursuant to section 655 of this title, or regulations prescribed pursuant to this chapter may be assessed a civil penalty of not more than $70,000 for each violation, but not less than $5,000 for each willful violation (b) Citation for serious violation Any employer who has received a citation for a serious violation of the requirements of section 654 of this title, of any standard, rule, or order promulgated pursuant to section 655 of this title, or of any regulations prescribed pursuant to this chapter, shall be assessed a civil penalty of up to $7,000 for each such violation [emphasis added]. Each year, OSHA adjusts these penalties for inflation, so for 2021, the fines are not actually capped at $70,000 and $7,000, but $136,532 and $13,653 per violation. If House Democrats get their way, by enacting the page 168 changes, those fines would increase to $700,000 for willful and repeated violations and $70,000 for serious violations.   Section 654, cross-referenced in the OSHA enforcement penalty code, outlines the law requiring workplaces to be “free from recognized hazards” causing harm or death: 29 U.S. Code § 654 - Duties of employers and employees (a) Each employer— (1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees; (2) shall comply with occupational safety and health standards promulgated under this chapter. (b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this chapter which are applicable to his own actions and conduct [emphasis added]. OSHA has already published a rule this year claiming Covid-19 is a workplace hazard, and the agency is using this provision of law to assert and enforce its authority. It is likely the new rule to enforce Biden’s mandate will also use this authority, and by extension use the fines upon enforcement. Huge Crippling OSHA Fines, Likely By Design The crippling change described on page 168 of the Democrats’ bill isn’t a typo or a clerical error. It was inserted by design and, likely, with the hope that no one would notice before Democrats ram the bill through Congress. If enacted, it could bankrupt a whole host of companies that do not believe they should have to comply with the Biden administration’s mandate or harbor the cost of intrusive, weekly tests. In its June 2021 emergency rule affecting health care workers, OSHA complained it was having a hard time motivating employers with its paltry $13,653 fine: “OSHA has been limited in its ability to impose penalties high enough to motivate the very large employers who are unlikely to be deterred by penalty assessments of tens of thousands of dollars, but whose noncompliance can endanger thousands of workers …” The Critics Some have openly discussed businesses defying the mandate and taking their risks with OSHA fines. For example, Rep. Chip Roy (R-TX) tweeted that businesses “should openly rebel” against any OSHA rule. It’s one thing to defy a $14,000 fine. It’s quite another to risk incurring hundreds of thousands of dollars in fines. One or two disgruntled employees, for example, could bring an employer $70,000-$140,000 in OSHA fines. If considered “willful,” as per Rep. Roy’s tweet — just three “violations” could quickly become a $2.1 million OSHA fine. Conclusion: If its provision becomes law, the Biden administration may force American businesses to choose between vaccinating their employees, testing them weekly for Covid-19, or going bankrupt under crippling OSHA fines. In September, Biden warned the tens of millions of Americans who have declined vaccination against Covid-19, “We’ve been patient. But our patience is wearing thin, and your refusal has cost all of us.” Now the Democrats in the House are hoping to make employers foot the bill for that “cost” in the form of fines and bankruptcy. Most New York Healthcare Workers Fired Over Vaccine Mandate Won't Get Unemployment Insurance By Kelly Gooch of Becker's Hospital Review Healthcare workers who are fired for refusal to comply with the state's COVID-19 vaccination mandate likely won't be eligible for unemployment insurance, according to state officials.   In a statement released Sept. 25, New York Gov. Kathy Hochul's office said the New York Department of Labor has issued guidance to clarify that terminated workers won't be eligible for the benefits unless they have a valid physician-approved request for medical accommodation. The governor's office made the announcement at the same time it unveiled a plan to address staffing shortages should a large number of healthcare workers leave hospitals and other facilities because of the state mandate. New York's mandate requires healthcare workers at hospitals and nursing homes to receive their first vaccine dose by Sept. 27. Workers at additional entities covered by the mandate, including diagnostic and treatment centers, home health agencies, long-term home healthcare programs, school-based clinics and hospice care programs, must have at least one dose by Oct. 7. "Workers in a healthcare facility, nursing home, or school who voluntarily quit or are terminated for refusing an employer-mandated vaccination will be ineligible... absent a valid request for accommodation because these are workplaces where an employer has a compelling interest in such a mandate, especially if they already require other immunizations," according to the New York Department of Labor website. Ms. Hochul's office has said the state will consider deploying National Guard members, as well as partnering with the federal government to deploy disaster medical assistance teams to help local healthcare systems. "This Is Completely Avoidable" - New York Hospitals Prepare For Staffing Crisis As Vaccination Mandate Forces Mass Firings With President Biden's federal vaccine mandate set to take effect on Monday, health-care systems around the country are suspending elective in-patient surgeries and refusing to accept ICU patients from other hospitals as they brace for potentially hundreds of firings of nurses and other critical staffers, potentially even doctors. According to the NYT, the Erie County Medical Center in Buffalo is planning to do all that and more, as it says it may soon fire about 400 employees who have chosen not to get the single job required by the edict (which was pushed through despite being blocked by a federal judge). Similarly, officials at Northwell Health, the state's largest health-care provider, estimate that NWH might be forced to fire thousands of people who have refused to get vaccinated. In an economy with more job openings than workers - 2.2MM more, to be exact - forcing workers to choose between employment and their health or religious compunctions simply isn't a smart idea. Without even a hint of self-awareness, the governor apparently agrees: "What is looming for Monday is completely avoidable, and there’s no excuses,” Ms. Hochul said, pleading for those who have not done so to get vaccinated," Hochul said during a weekend press briefing. But we digress. The situation is less dire in NYC, but there will still be plenty of hospitals left with massive staffing holes after mass-firings. The city's largest private hospital network, NewYork-Presbyterian, has more than 200 employees who may face termination because they haven't received at least one jab. Of course, as we have pointed out in recent posts, health-care workers are only a fraction of the worker who will be impacted by shortages across the economy. In California, nurse shortages have reached crisis levels in California, airlines are seeing flights frequently cancelled due to worker shortages. As of late September, 84% of NY's 450,000 hospital workers and 83% of nursing home workers - which number around 45,400 - remained unvaccinated.  Despite being directly threatened by their superiors, most say they're refusing the jab on religious or health grounds, or because they're allergic to certain ingredients. In an effort to scare workers into compliance, NY Gov. Kathy Hochul has threatened to find "foreign workers" to staff the Empire state's hospitals and care homes (despite the fact that vaccination rates are much lower in most of the world outside the US). She has also threatened to call in the National Guard or order a state of emergency in a plan unveiled over the weekend. NY's teachers are also facing a mandate to either get vaccinated or kiss their jobs goodbye. Roughly 10,000 public school workers, that's compared to 75K teachers and tens of thousands of other employees from custodians to paraprofessioanls. Circling back to hospitals and care homes, institutions like Northwell are being relatively parsimonious with their exemptions for religious and health reasons, But some are getting through . NY's emergency order doesn't stipulate how exactly hospitals and nursing homes should enforce it, and there's a good chance that hospitals serving communities in greater need will be forced to make exceptions. Black and Hispanic New Yorkers have gotten the jab in far lower numbers than white new Yorkers. The NYT points out in its story that some hospitals in the Bronx see unvaccinated rates among doctors and nurses reaching into double-digit territory. At St. Barnabas Hospital in the Bronx, about 12 percent of the nearly 3,000 employees had not been vaccinated as of midday on Friday, the chief medical officer, Eric Appelbaum, said in an interview. The group includes roughly 3 important doctors, and plenty of badly eed studiws Anecdotally hospitals are reporting a surge in vaccinations among hospital workers who haven't yet been vaccinated. "It's Not The Same Thing": Jen Psaki Asked Why Migrants Walking Across Border Don't Have To Show Vaccine Proof After the earlier Biden-mandated vaccine requirement for federal workers and all armed forces branches, and with the city of D.C. itself now issuing a vaccine mandate for public school student athletes and child care center staffers, a big segment of the US public is questioning: where will it end? After all, even a potential future requirement to show proof of Covid vaccine to merely travel domestically on an airline is still "on the table" as an "option".  With these stringent and watchful federal, state and local regulations -including masking in some places - being increasingly imposed on American citizens, one might assume at minimum there are vaccine and Covid testing requirements in place for migrants who are now walking across the border, often setting up camps in crowded conditions on the US side of the border. But that would be to assume wrongly, given the following exchange between a Fox White House correspondent and Biden's press secretary Jen Psaki... Peter Doocy asks why vaccine cards are required for foreign travelers but not migrants at the border. Psaki: "They're not intending to stay here for a lengthy period of time. It's not the same thing." pic.twitter.com/NLA8G8fT2s — The First (@TheFirstonTV) September 20, 2021 Journalist Peter Doocy's question centered on the even more obvious: if foreign travelers entering the US are required to show proof of a Covid vaccine, then why not such a minimal requirement in place for illegals trying to cross the US-Mexico border?  "Is somebody asking the foreign nationals who are walking to Del Rio, Texas and who are setting up camps this side of the border for proof of vaccination or a negative Covid test?" he asked. Doocy further pointed out that currently those crossing the border don't even have to show a negative Covid test, apparently: "First of all, I can re-address for you what steps we take …" "So if somebody walks into the country, right across the river, does somebody ask to see their vaccination card?" Doocy asked. "Well, let me explain to you again, Peter, how our process works," the press secretary said. Psaki said that as migrants come across the border, they are screened for symptoms of COVID-19 and quarantined if they are symptomatic. Del Rio, TX migrant camp And that's where Psaki tried to dodge the question altogether, while also implying that no, there are no requirements in place at the border. "They are not intending to stay here for a lengthy period of time," she continued. "It’s not the same thing. These are individuals, as we’ve noted … we are expelling individuals based on Title 42 specifically because of COVID. Because we want to prevent a scenario where large numbers of people are gathering, posing a threat to the community and also to the migrants themselves." "I am offended that a police officer could potentially lose their job," he said on Thursday. DeSantis has opposed broad vaccine requirements and mask mandates in K-12 public schools. Republican Gov. Ron DeSantis of Florida, a vocal opponent of COVID-19 vaccine mandates, on Thursday said that the state will fight the federal government in court over legislation regarding such requirements.DeSantis, a potential 2024 presidential candidate, has spoken out forcefully against vaccination rules placed on employers, and last month said that President Joe Biden's vaccine mandate was a violation of Florida law."Let's not have Biden come in and effectively take away - threaten to take away - the jobs of people who have been working hard throughout this entire pandemic," DeSantis said during a news conference this week. "I am offended that a police officer could potentially lose their job.""I just think it's fundamentally wrong to be taking people's jobs away, particularly given the situations that we see ourselves facing with the economy," he added.The rule from the federal government mandates that employers with over 100 workers must require vaccination or conduct weekly testing, which would affect about 80 million Americans. The broader mandate would also affect about 17 million healthcare workers who are employed by hospitals that accept Medicare and Medicaid reimbursement, along with federal employees and contractors.Republicans last month quickly pounced on Biden's move.Even Gov. Asa Hutchinson of Arkansas, who has traveled throughout his conservative in an effort to boost the vaccine, said that Biden's decision to enact a federal mandate was not helpful to increasing inoculation levels among the public."I support businesses being able to require vaccination, but it's their own independent choice for their workplace," he said last month. "But to have the federal mandate will be counterproductive. It's going to increase resistance. We're going to grow our vaccinations whether you have this or not."DeSantis, who has rejected the use of vaccine passports and waged battles with school districts that have sought to implement mask mandates, recently appointed Dr. Joseph Ladapo to become the state's new surgeon general.Ladapo, who opposes mask mandates and feels that COVID-19 vaccines are "nothing special," last year boosted the use of the drug hydroxychloroquine to fight the coronavirus. The World Health Organization earlier this year said that hydroxychloroquine is not an effective form of treatment for COVID-19.Recently, the Florida Department of Health leveled a $3.57 million fine against Leon County, which encompasses the state capital of Tallahassee, after the jurisdiction mandated that hundreds of workers receive the vaccine.The county terminated the employment of 14 workers who chose not to receive the vaccine, according to The Tallahassee Democrat, and local officials are prepared to defend the requirement in court.A recent study conducted by the French government-backed scientific organization Epi-Phare, which looked at nearly 23 million individuals, found that vaccines reduced the risk of contracting a severe case of COVID-19 by at least 90% among individuals 50 years old or older. As Insider's Eliza Relman previously reported, medical professionals as well as public health and legal experts, have praised vaccine and testing mandates as effective and constitutional tools to promote public health -- especially as the unvaccinated pose a threat to others' health and safety.DeSantis said that the state's lawsuits against the federal mandates will be filed in the United States Court of Appeals for the Eleventh Circuit.Florida, which this past summer experienced a surge in new COVID-19 infections fueled by the highly infectious Delta variant, has seen over 57,000 of its residents succumb to the virus since the beginning of the pandemic, according to the latest data compiled by Johns Hopkins University.Read the original article on Business Insider.....»»
